UtilitySavers – Terms and Conditions
Last Updated: September 2024
These Terms and Conditions (“Terms”) set out the basis on which UtilitySavers (“we”, “us”, “our”) provides energy and utility brokerage services to business customers (“you”, “your”). By using our services, you agree to be bound by these Terms. Please read them carefully.
1. About Us
UtilitySavers is an independent energy and utility broker, helping businesses to compare and secure contracts with a panel of suppliers. We are not a supplier ourselves. Instead, we act as an intermediary between you and your chosen supplier.
2. Scope of Our Services
- We provide impartial business energy comparison and switching services based on the information you provide.
- Our recommendations are drawn from the tariffs made available to us by our panel of suppliers at the time of your enquiry.
- We do not guarantee to cover every supplier or tariff available in the market.
- We do not charge the customers directly. We are paid by suppliers, typically via commission, when a contract is agreed.
3. Your Responsibilities
By using our services, you confirm that:
- All information provided (including business details, consumption data, and existing contract terms) is accurate and complete.
- You have authority to enter into contracts on behalf of your business.
- You are responsible for reviewing supplier terms and conditions before agreeing to any contract.
- You are responsible for complying with your existing supplier’s obligations, including any termination fees.
4. Supplier Contracts and Binding Commitments
- When you agree (verbally, electronically, or in writing) to a supplier’s contract through UtilitySavers, a legally binding agreement is created directly between you and the supplier.
- Business energy contracts do not carry a statutory cooling-off period. Once you have agreed to a contract, you are bound by its terms for the full duration.
- You cannot cancel or withdraw from a contract unless explicitly permitted by the supplier’s own terms (which is rare).
- UtilitySavers accepts no liability if you seek to cancel a contract once agreed, or if the supplier enforces charges, penalties, or termination fees.
5. Fees and Commissions
- You will not be charged directly for using UtilitySavers.
- We are typically remunerated by suppliers through commission when you enter into a contract via our service.
- Commission may vary between suppliers and contract types, but it does not affect the price you pay to the supplier.
6. Liability
We exercise reasonable care and skill in providing our brokerage service. However, we are not responsible for:
- The performance, billing, or service delivery of any supplier.
- Savings or benefits promised by suppliers.
- Any consequences arising from incorrect or incomplete information you provide.
Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by our negligence.
7. Data Protection and Privacy
We handle your business and personal data in accordance with applicable data protection laws, including the UK GDPR and the Data Protection Act 2018.
By using our service, you consent to us sharing your information with relevant suppliers for the purpose of obtaining quotes and arranging contracts.
For more detail, please refer to our Privacy Policy.
8. Termination of Service
- You may choose to stop using our services at any time before agreeing to a supplier contract.
- Once you have entered into a supplier contract, termination will be governed solely by that supplier’s terms.
- We reserve the right to withdraw or suspend services if you breach these Terms or provide false or misleading information.
9. Governing Law and Jurisdiction
These Terms are governed by and shall be construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
